The Proceeds of Crime Act 2002 (POCA), the Terrorism Act 2002 (TACT) and the Financial Conduct Authority Handbook of Rules and Guidance (each as amended from time to time) impose obligations on the College in respect of money laundering and associated activities.
The College is regulated by the Financial Conduct Authority (FCA) for certain consumer credit activities including entering into regulated credit agreements as lender. However, the College does not consider that it is within scope of the Money Laundering, Terrorist Financing and Transfer of Fund (Information on the Payer) Regulations 2017 (MLRs) as the College does not come within the MLRs definition of a “financial institution”.
